Terms of Use – NeoVista

1. Acceptance of Terms

By downloading, installing, accessing, or using the NeoVista application (the “App”), you agree to be bound by these Terms of Use. If you do not agree, you must not use the App.

These Terms form a legally binding agreement between you and NEOVISTA FZCO.

2. Eligibility

• Be at least 16 years old (or older, if required by your local laws)
• Have the legal capacity to enter into a binding agreement
• Not be barred from using the App under any applicable laws

3. User Conduct

You are solely responsible for all content, communication, and actions carried out through your use of NeoVista. You agree not to use the App to:

• Engage in unlawful, fraudulent, or harmful activities
• Harass, abuse, threaten, or impersonate others
• Distribute illegal, obscene, defamatory, or offensive content
• Violate the rights of any third party (including intellectual property rights or data privacy laws)
• Attempt to bypass, modify, or reverse-engineer any part of the App
• Use automated scripts or bots unless explicitly permitted

4. Account and Access

NeoVista does not require traditional usernames or passwords. Access is granted through invite-only registration or administrator approval. You are responsible for securing your device and any backup mechanisms.

You may not share access to your account or device for purposes of impersonation, fraud, or misuse.

5. Privacy and Data Handling

NeoVista collects minimal data and does not store the content of messages or calls. For full details, refer to our Privacy Policy.

By using the App, you acknowledge and agree that:

• You are solely responsible for your data and its use.
• Messages and files are encrypted and not accessible by NeoVista
• Temporary metadata and diagnostic logs may be collected for service delivery and abuse prevention

6. Intellectual Property

All intellectual property rights in the App, including design, source code, branding, and documentation, are owned by NEOVISTA FZCO.

You may not:

• Copy, distribute, or create derivative works of the App
• Use NeoVista’s name, logo, or trade dress without written permission
• Reverse-engineer, decompile, or extract the source code of the App

7. Subscription and Payments

• NeoVista operates on a paid subscription model. Subscription fees are charged in accordance with pricing shown in the App or on the relevant app store.
• Subscriptions auto-renew unless cancelled prior to renewal date
• Payments are processed through third-party platforms (e.g. Google Play, Apple App Store)
• No refunds are provided once a billing cycle has begun, unless required by law

8. Limitation of Liability

• NeoVista is provided “as-is” and “as-available”, with no warranties of any kind
• NEOVISTA FZCO shall not be liable for any indirect, incidental, or consequential damages arising from your use of the App
• NEOVISTA FZCO does not assume liability for user-generated content or unlawful use of the App

9. Termination

We may suspend or terminate your access to NeoVista at any time, with or without notice, for:

• Violation of these Terms
• Legal or regulatory requirements
• Abuse, harassment, or security threats

You may also delete your account or stop using the App at any time.

10. Governing Law and Jurisdiction

These Terms are governed by the laws of the United Arab Emirates, specifically under the jurisdiction of the IFZA Free Zone Authority, Dubai.

You agree that any dispute, claim, or controversy arising from these Terms or your use of NeoVista shall be resolved exclusively in the courts of Dubai, UAE (IFZA jurisdiction).

11. Changes to the Terms

We may update these Terms from time to time. If we make significant changes, we will notify users within the App. Continued use after changes indicates acceptance of the new terms.
